Auction User Agreement



Introduction:

Mersaat (Mersaat) welcomes all users who wish to utilize our electronic auction services. This agreement outlines the terms and conditions that govern the use of our application and auction services. By using the application, you agree to fully abide by these terms and conditions.

1. General

1.1 By using the Mersaat application, you agree to comply fully with all terms and conditions mentioned herein.
1.2 The company reserves the right to amend these terms and conditions at any time, with changes becoming effective immediately upon publication.
1.3 You are responsible for reading and understanding these terms before using the application.
1.4 All prices are displayed in UAE Dirhams (AED). The company is not responsible for currency exchange fluctuations.
1.5 Additional fees (such as VAT or any applicable taxes) will be added to the total price and are to be borne by the buyer.
1.6 Participation in auctions requires a financial deposit, the amount of which is determined per auction.
1.7 The company reserves the right to negotiate with the buyer for a price higher than the supplier's specified price, and any price difference will be retained as additional profit for the company.

2. Eligibility

2.1 The application is restricted to individuals capable of entering into legally binding contracts under UAE laws.
2.2 Users must provide accurate and truthful information during registration.
2.3 The company reserves the right to refuse services to any user who violates the terms and conditions.y.

3. Registration

3.1.Users must register on the application before participating in any auction.

3.2. Registration requires the submission of a valid ID and credit card details.

3.3. Users are responsible for ensuring the accuracy of the provided information and updating it when necessary.

3.4. Sharing accounts with others is strictly prohibited.

4. Auctions

4.1. All auctions have specific start and end times, as well as a minimum starting price.

4.2. Bids cannot be canceled once placed.

4.3. The highest bidder will receive a notification and must complete the payment within 24 hours.

4.4. The company reserves the right to extend auctions in the event of late bids or technical issues.

4.5. Suppliers have the right to reject the highest bid if it does not meet the required price.

5. Payment

5.1. Payments must be made using accepted methods (such as credit cards or bank transfers).

5.2. Buyers are responsible for all additional fees, such as taxes or credit card charges.

5.3. A late payment penalty of 1% per day will be applied in case of delays.

6. Item Delivery

6.1. Buyers are responsible for collecting the purchased items from the designated location within 3 days of the auction's conclusion.

6.2. Additional storage fees of AED 50 per day will be applied for delays in item collection.

6.3. The company is not responsible for delays caused by the buyer.

7. Privacy and Security

7.1. The company is committed to protecting user data in accordance with its privacy policy.

7.2.  No data will be shared with third parties without the user's consent or a legal requirement.

8. Responsibilities

8.1. Users are responsible for maintaining the confidentiality of their account details and passwords.

8.2. Misuse of accounts or data will result in account suspension and legal action.

8.3. The company ensures system maintenance but is not responsible for internet or device-related issues affecting the user.

9. Intellectual Property Rights

9.1. All application content, including text, graphics, and logos, is owned by Mersaat or its licensed parties.

9.2. Reproducing, republishing, or redistributing any application content without prior authorization is strictly prohibited.

10. Disputes and Applicable Laws

10.1. This agreement is governed by the laws of the United Arab Emirates.

10.2. In the event of disputes, amicable resolutions will be sought first. If unresolved, disputes will be referred to UAE courts.
